The use of “illegal immigrant” in Idaho rapist story creates false connection

LatinaLista — An appalling story out of St. Anthony, Idaho speeded across the Internet this morning. According to Idaho Falls CBS affiliate, KIDK, a 10-year-old girl gave birth to a 6 lb. baby girl as a result of being raped.

The news story on the KIDK site read in part:

That person is this man, 37-year old Guadalupe Gutierrez-Juarez. Juarez is actually an illegal immigrant, and is now behind bars in the Fremont County Jail on other rape charges.
Since we broke this story exclusively yesterday, we’ve been checking with sources throughout the North Valley for more information.
The criminal complaint against Gutierrez-Juarez says the rape of the 10-year old happened between November and January. As we told you last night the girl gave birth at Madison Memorial this weekend and both mother and child are doing well.
If convicted the illegal immigrant could face life in prison, a $50,000 fine ,or both. Whether he ever serves anytime behind bars will be up to the judge who if he places him on probation, could deport him.

From the way this story reads, “If convicted the illegal immigrant could face life in prison,” dehumanizes not just the intended target, the rapist, but ALL undocumented immigrants. Also, it makes it sound that this was a stranger-on-stranger crime.
It wasn’t.
The rapist was married to the girl’s mother. Latina Lista has yet to verify if the rapist was the child’s father.
At any rate, it should go without saying that not all undocumented immigrants are rapists but this article definitely plants the connection between the two terms.
A rapist is a rapist regardless if he’s an undocumented immigrant, a church pastor, a police officer, a teacher, etc. In fact, in most articles, the rapist is identified by his/her name and not by an identifier of their legal or immigration status.
By repeatedly referring to this rapist as the “illegal immigrant,” this media story does a disservice to the local community and popular perception of all undocumented immigrant men who are Latino.
To their credit, in subsequent reports, KIDK refrained from identifying Gutierrez-Juarez only as an “illegal immigrant” and used his last name when referring to him. Unfortunately, not all news outlets are doing this.
Yet, the story here is not just that this sick individual committed this horrendous crime but that nobody found out about it nor did anything until this child gave birth.
However, we’re discovering that there is much more to the story.


According to various news reports, the girl’s pregnancy was not reported until the end of April when she went to the hospital to be seen. Ultimately, she delivered the baby by Cesarean.
However, a credible source told Latina Lista that it wasn’t her mother who took her to the hospital but someone from her school — hospital officials called the police. That nugget of information opens the door to a host of questions.
If the girl was still attending school, surely someone should have seen that she was pregnant. That she was still living in the same home with the guy, means that the mother is either complicit in the rape and should be arrested as well for endangering her daughter or a victim of abuse herself.
Police report that they don’t have any prior complaints on the 37-year-old rapist which means that he and the girl and the mother, and any other possible children in the family, went about their business as usual for all the world to see.
So why didn’t anyone see anything or say anything?
An interesting theory offered by our source says that for one thing, the privacy and confidentiality rules regarding schools and hospitals are strictly enforced. Our source tells us that the public schools in the area, in over 10 years, have not shared any news with local media.
Another theory is that the community where the girl lives is “close knit.” Evidently, there is a high Mormon population in the state and according to the source, some communities just take care of one another.
Does that mean they condone underage sex, a la the polygamist sect that was recently raided in Central Texas?
No one knows for sure the details until a hearing next week when some things should be made public.
But one thing is certain — the rape of a child by anyone should not be condoned nor kept silent due to confidentiality laws or religious practices.
The emotional and physical well-being of children should be the priority of every community.
And when someone is proved to be a rapist, they should be identified as such but the implication, intentional or not, should not be made that others of their group are the same as that one sick person.

    That age difference is just UNACCEPTABLE.
    And the age of the girl is UNACCEPTABLE.

    What difference does it make whether it was a stranger or a step father. It is what it is. An illegal alien raped a 10 year old girl. He deserves to be sent to prison for life if not worse.

    maybe nobody came forward because they were all scared of being deported? (and I’m thinking about the “close knit community” here, rather than the school officials–the school officials should have said something–in my state they are required to report suspected abuse–don’t know if they have the same rules out there).

    Actually, if he hadn’t been in this country illegally the crime would never have happened. We can’t do anything about our own home grown criminals being here but we don’t need to increase our crime by adding illegal aliens to the mix.

But this is a fundamental way to plant fear of people who are basically unknown and “different” from mainstream society.

    There are a few issues I would like to raise. What happened to this girl, a girl who is the same age as my daughter, is horrible, disgusting, and disturbing.
    And yes, you are correct that labeling the rapist as a illegal, serves no purpose beyond engaging in racial profiling and fear mongering.
    That said, it is problematic to point the finger at the mother, without bringing up the very likely possibility that the mother herself is undocumented and likely may be a victim of abuse/rape as well. Perhaps the mother was scared of being deported/detained and being separated from her daughter. for example.
    The story goes beyond the rapist and his status. What of the girl’s status? Will she be further victimized by being targeted herself now by the department of homeland security? Is she getting proper healthcare, mental health care etc.
    We need to expand our thinking when reporting on such stories

    It is a sad fact that child rape/sexual abuse is most commonly committed by male family members. The vast majority of these crimes is of course committed by American citizens in the US, simply because American citizens are the majority population. Data show that these crimes occur with equal incidence in all American socioeconomic groups. There are no data that these crimes are more or less common among immigrants, undocumented or not.
    Linking this heinous crime to the perpetrator’s immigration status in a news story is absurd. It is Nazi-type propaganda against immigrants.

    Rape is rape. It is a deplorable crime, especially against a child. The rapist should be tried and serve the severest and fullest penality when found guilty.
    This is how the article should have been reported. You dimish the crime and the individuals when you try to sway the crime to ethnicity, religious or immigration status. Additionally, regardless of these statuses, it is the guilty party that is guilty, NOT all those in the same status. It is absolutely ridiculous when the media tries to gain “breaking news” theatrics purely by adding the immigration status to the story. They are purposely indicting an entire group on the guilt of ONE heinous criminal. It would be as if we indict all white males over 40 based on the BTK or Gacy.

    This is terrible! Hearing the story on the evening news, I immediately picked out the media’s attempt to highlight this man’s immigrant status. I don’t see this story having anything to do with the immigration issue. Acts of molestation and incest are problems that our societies need to continue to address. This incident is not isolated to this family or even to their ethnic background. This type of situation was taking place in Texas with the Latter Day Saints sect that had over 300 children removed from their compound. The children were removed because the authorities were tipped off about the possibility of sexual and physical abuse. Unfortunately, in cases were abuse is taking place in the home, no one protects the child. The mother of this 10 year old child was certainly ignoring the problems for either selfish reasons or for fear of undetermined consequences. There is no way that a parent will not become aware that there are problems with their child. The whole family had problems. I hope that child is given the opportunity to continue with her life and heal. She will not understand this for many years to come, may the higher source provide her with strength. I also hope the newborn child is given to a compassionate and caring couple that can love and nurture the child. The girl’s mother should be sent to therapy. The man should be place in jail and made to repay his debt for the rest of his years. Sexual abuse hides in the dark chamber of our homes. It exists in the holiest of places and in the minds of individuals who have lost respect for themselves and ignore the sacredness of childhood.

    Frank is right, this man is an example of those illegal immigrants who comprise the criminal element who cross our unguarded borders every day. If we had control of every person crossing our borders, many of those with prior records of crime in Latin America would not be permitted entry. Those who deride our so-called militarization of the border and a fence conveniently and heartlessly forget the collateral damage of free transit of our sovereign border by such people. It’s more important to them that millions of those without criminal tendencies cross than it is to prevent harm to citizens. They love to cite that “immigrants”, (they include illegals in this mass of humanity) commit crimes at a lower rate than citizens, all-the-while forgetting that the legal variety are vetted for criminal records, and the bad applicants are denied immigrant status, so it’s alright to let illicit border crosser rapists, murderers, drug dealers and MS-13 gang members through. After all, it’s for the greater good of Latin American foreigners and citizen alike. To me and other reasonable Americans, this is enough justification to build a fence.

    Gee, I can’t imagine why, when there are known to be criminals among illegal aliens, and that these people actually commit crimes in the U.S., that illegal aliens would be a suspect class. Of course citizens should be understanding, unsuspecting and give all of them the benefit of the doubt. This type of thinking smacks of irrational expectations. Take off your rose colored glasses, get real, set your Latina bias aside and start thinking objectively. Only then will you understand how the rest of us feel.

And for the record, each of these immigrants who comes over and does much-needed labor is hardly illiterate. As far as “taco-eating pedophiles,” I’m just as sick of holy collar-wearing pedophiles, teacher pedophiles, and the list goes on.

    Maegan, you’re so right in your points. Yet, when I reported this story I couldn’t get verification of the ethnicity of the mother or daughter and so beyond proposing that the mother was an abuse victim herself, I could only speculate. There are definitely a lot of unknowns in this story.

    Yet, no one objects when a criminal is identified as a Black or a White person and identified as a citizen of this country. The only objection seems to be is when a criminal is identified as a Hispanic and especially if they are in this country illegally. They are what they are. Let’s identify them all accurately. If anyone is stupid enough to think that it means that everyone from one ethnic group is a criminal or is a citizen or a non-citizen, then they lack no common sense or logic anyway.

    We will see if that cowardliness continues to grow here in the US. If so, people will not be able to address the actual causes for the sinking of this country into a pile of debt, unemployment, foreclosed homes, drug use, mental illness, obesity and the diseases that come with it, ignorant children, and violence.

    Evelyn, I’m not sure I understand your point. Surely you are not suggesting that only people who identify as Republicans are guilty of sex crimes? Because anyone could go online, research news stories, and come up with a list of people affiliated with the Democratic Party who are guilty of the same.
    Just off the top of my head I recall a case not too far from where I live where the head of an ACLU chapter was arrested for being in possession of child pornography depicting the violent rape of children. Highly doubtful that he was a Republican.
    I understand the point about hypocrisy. Someone who exhibits a pattern of immoral lifestyle, yet rails against that same behavior would most definitely fall in that category. But there are hypocrites in all walks of life, all political parties, all races, ethnicities, and religions.
    Just because an individual advocates for moral standards does not mean that they themselves will not sometimes fall short of that ideal. Of course, if one has no standards whatsoever, they will most likely never run the risk of being called a hypocrite. But, I don’t think that is the solution. If only perfect people tried to advocate for moral standards in our society, there would be nobody to take on that role as nobody is without sin.
    As well, I don’t quite understand what a person’s political affiliation has to do with the issue of those in the country illegally committing heinous crimes. Obviously, if our government was doing their job and enforcing immigration laws, these people wouldn’t be here to commit these crimes. And from what I have read, they often prey on the immigrant community. And keep in mind that there are illegals here from many different countries–Asian, Eastern European, etc. The Russians are active in the sex trafficking and other crimes. Sure, we’d still have our own dirtbags, but we have enough of our own to deal with without having to concern ourselves with foreign nationals in the country illegally IMO. That just seems to be common sense to me.

Is one really suggesting that only Republicans commit sex crimes?? One makes a total fool out of oneself if they think so.

The reason these people hate Republicans so much is because in their twisted mind, the Republican Party is the party of those evil “white people.” I will all but guarantee you if the majority of the Republican Party were non-white, the feelings towards it would not be as intense. It is blatant hypocrisy because they rail against “demonizing and stereotyping” illegals, but they do the same thing towards entire groups of people they do not like. They are even worse because they actively hate people for no other reason than they disagree with their political views. Unbelievable!
    If these people gained real power in this country it would be a nightmare as they would shut down any and all speech with which they disagreed. They are the fascist left. They are physically attacking conservative speakers on college campuses and intimidating anyone who would try to listen to them or allow them to speak.     No one here, racist or not, is focusing on Hispanic immigrants. They are welcomed to America as long as they have followed proper procedures to gain entry. If not, they are here illegally and that is where the focus is directed. America has its hands full with home-grown criminals, but the crimes committed by those illegally in America would be the most preventable by not allowing that individual to be here in the first place.

    Of course it doesn’t really matter that the people we’re talking about came uninvited, evaded our Border Patrol, and continue to enter by the tens of thousands without a background check. After all, their all babes in the wood innocents who wouldn’t think of running away from Mexican law enforcement or packing drugs or deal in human trafficking. It’s all just so much hysteria and racism.
