MONTGOMERY, Ala. — On March 2, members of the Alabama Coalition for Immigrant Justice, warned state lawmakers of the devastating financial and social costs of anti-immigrant legislation such as the proposed House Bill 56.
The coalition members, from the American Civil Liberties Union of Alabama, Alabama Appleseed Center for Law & Justice, and the Southern Poverty Law Center, pointed to the experiences of communities and states across the country that have already enacted similarly harsh and unconstitutional anti-immigrant legislation.
Jared Shepherd, a law fellow with the American Civil Liberties Union of Alabama, detailed the unconstitutionality of the proposed legislation citing the mounting legal setbacks proponents face defending the similar Arizona bill.
“In July 2010, the United States District Court for the District of Arizona ruled in favor of the United States on key elements of its Motion for a Preliminary Injunction. The Court found that the U.S. was likely to succeed on the merits in proving that the four central provisions of the bill were preempted by federal law,” Shepherd said, “I strongly encourage this body, and the Legislature, not to follow in Arizona’s footsteps in passing a Constitutionally flawed piece of legislation.”
